1) About These Terms

These Terms & Conditions (“Terms”) govern your access to and use of the HM Tucker Inc website and online services (the “Site”), including pages where you submit applications, upload verification documents, sign up for updates, or contact us. By using the Site, you agree to these Terms and to our Privacy Policy.

Who we are: H M Tucker Inc is a New York nonprofit corporation operating programs nationwide, including the Florida Education Grants program (the “Florida Chapter”). Contact: support@hmtuckerinc.org. 727-687-2768 (Mon–Fri, 9–5 ET). EIN: 27-3394824.

2) Eligibility & Accounts

  • You must be 13 or older to use the Site. Applicants under 18 must have parent/guardian consent where required.

  • You are responsible for the accuracy of information you submit and for maintaining the confidentiality of any account credentials (if accounts are enabled). Notify us promptly of any unauthorized use.

3) Program Information; No Guarantees

Information on the Site about eligibility, timelines, and awards is provided for general guidance and may change. Awards are discretionary and subject to available funds and verification. Submitting an application does not create an entitlement to funding.

4) Applications & Verification

By submitting an application, you represent that all information and documents are true, complete, and accurate. When you check the applicable boxes and provide a typed e-signature, you:

  • Consent to use of electronic records and electronic signatures;

  • Authorize H M Tucker to verify your enrollment/program/credential status with your institution(s) or the National Student Clearinghouse (as applicable); and

  • Acknowledge that false or misleading information may result in denial, revocation, or repayment obligations where permitted by law.

5) No Online Donations or Payments

We do not accept donations or payments online through this Site. Do not submit payment information here. If you wish to support our work, contact us at support@hmtuckerinc.org or 727-687-2768 for offline giving options. Any references to donations on the Site are informational only.

6) Communications (Email, Phone, SMS)

By providing contact information, you agree we may contact you about your application, verification, or updates. Text/SMS messages may be sent using automated technology; message/data rates may apply. You can opt out of texts by replying STOP and opt out of non-essential emails via the unsubscribe link. We will continue sending essential notices (e.g., application status).

7) Acceptable Use

You agree not to:

  • violate any laws or third-party rights;

  • submit harmful code, attempt to gain unauthorized access, or disrupt the Site;

  • submit content that is unlawful, harassing, defamatory, discriminatory, or invasive of others’ privacy;

  • misrepresent your identity or eligibility.
    We may suspend or terminate access for violations.

8) Intellectual Property

The Site and its content (text, graphics, logos, design) are owned by HM Tucker or licensed to us and protected by law. You may use the Site for personal, non-commercial purposes. No license is granted to copy, modify, distribute, or create derivative works except as permitted by law or with our written consent. HM Tucker Inc and related marks are trademarks/service marks of HM Tucker.

9) User Content & License to Us

If you submit content (e.g., statements in your application, testimonials you choose to provide), you grant HM Tucker a non-exclusive, royalty-free license to use that content to operate and improve our programs and to comply with legal obligations. We will not publish your story, photo, or testimonial for publicity without your separate, explicit consent.

10) Third-Party Services & Links

The Site may embed or link to third-party services (e.g., form providers, maps, videos, file-delivery tools). Those services are governed by their own terms and privacy policies. We are not responsible for third-party sites. We do not process payments on this Site and do not request or store payment card information.

11) Privacy, Cookies & Security

Your use of the Site is subject to our Privacy Policy, which explains what we collect and why, how we protect it, and your choices. We implement reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the data and consistent with applicable law, including New York’s SHIELD Act. No method of transmission or storage is 100% secure.

13) Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HM TUCKER AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF

15) Indemnification

You agree to defend, indemnify, and hold harmless H M Tucker and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site.

16) Changes to the Site or Terms

We may update the Site and these Terms from time to time. Changes are effective when posted to the Site with an updated Effective date. Your continued use after changes constitutes acceptance of the updated Terms.

17) Governing Law & Venue

These Terms are governed by the laws of the State of New York (without regard to conflicts principles). You agree to the exclusive jurisdiction and venue of the state or federal courts located in Erie County, New York, for any dispute arising from or relating to these Terms or the Site.

18) Severability; Waiver; Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. These Terms, together with our Privacy Policy, constitute the entire agreement between you and H M Tucker regarding the Site.
